The Parish Of Edlesborough Inclosure Award 1865

Private Carriage & Occupation Roads

For some time, Edlesborough Parish Council (EPC) has been endeavouring to find a better access for hearses to the Parish Cemetery, which is located at the rear of Edlesborough Church Yard.

During 2007, Councillor John Wilkinson undertook some extensive research at Bucks County Archive in Aylesbury, during which he came across “The Parish of Edlesborough Inclosure Award 1865”.

This Award included Road No. 5, which is part of the current bridleway from Edlesborough Church on the A4146 to Ivinghoe Aston.  Very helpfully, under this Award Allotment holders (i.e. owners of the various parcels of land along Road No. 5), and their successors in title, were given the right to take their carriages over the road.  So, it has now been established that EPC can use this Road to access the Cemetery via the strip of land it owns at the bottom of the church yard. 

EPC is now developing proposals and costings for building the new Cemetery access, and investigating ways in which the necessary funds can be raised.

In the meantime, EPC is indebted to Councillor John Wilkinson for his time and dedication in obtaining and typing the following Extracts From The Parish Of Edlesborough Inclosure Award 1865.

Please Note: The red and yellow mark ups on the maps are only approximate (especially roads 1 and 2 in Dagnall).  Anyone wishing to see a definitive map should refer to the original 1865 map in the Bucks County Archive.

Extracts From The Parish Of Edlesborough Inclosure Award 1865

Private Carriage & Occupation Roads

And I further declare that I have set out and appointed and do hereby set out and appoint the following private carriage and occupation roads that is to say:

Road No.1

One private carriage and occupation road of the width of twelve feet and numbered I on said map commencing at the Studham Road at the point marked AA on the said map and extending thence in a Southeastward direction to and terminating at an old Inclosure numbered 179C on the Tithe Appointment Map and on the map annexed at the point marked AU on the said map which said road is set out for the use of persons interested for the time being in the Allotments numbered 208 and 209 and the old Inclosures numbered 136, 176, 178, 179 179a, 179b and 179c respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 2) and on the map annexed.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are severally rated to the relief of the poor.

Road No.2

One other private carriage and occupation road of the width of twenty feet and numbered II on the said map commencing at the Studham Road at the point marked AB on the said map and extending thence in an Eastward direction to and terminating at the Southeast corner of an old Inclosure numbered 161 of the Tithe Appointment Map of the said parish of Edlesborough (part numbered 2) and on the map annexed at the point marked AW on the said map which said road is set out for the use of the persons interested for the time being in the said old Inclosure numbered 161.

And I direct and appoint that the said private carriage and occupation road shall for ever hereafter be maintained and repaired by the owner and proprietor of the old Inclosure numbered 161 on the said Tithe Appointment map and on the map annexed.

Road No.3

One other private carriage and occupation road of the width of twelve feet and numbered III on the said map commencing at the Edlesborough Green Road at the point marked AC on the said map and extending thence in a Northeastward and Northward direction to and terminating at the Allotment numbered 132 at the point marked AD on the said map which said Road is set out for the use of the persons interested for the time being in the Allotments numbered 132, 133 and 134 respectively.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are severally rated to the relief of the poor.

Road No.4

One other private carriage and occupation road of the width of twenty feet and numbered IV on the said map commencing at the Church and Eaton Gate Road at the point marked AE on the said map and extending thence in a Northwestward direction to and terminating in the Allotment numbered 98 at the point marked AF on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 98, 99, 100, 101, 102, 104, 103 and 105 and the old Inclosures numbered 172, 172a, 173 and 173a respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are respectively rated to the relief of the poor.

One other private carriage and occupation road of the width of twenty feet and numbered V on the said map commencing at Leighton Way at the Southeast corner of the church yard at the point marked AG on the said map and extending thence in a Westward direction to and terminating in the Allotment numbered 159 at the point marked AH on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 79, 80 and 159 respectively.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are severally rated to the relief of the poor.

One other private carriage and occupation road of the width of twenty two feet and numbered VI on the said map commencing at the Leighton Way at the point marked AI on the said map and extending thence in a Westward direction to and terminating at an old Inclosure numbered 61 on the Tithe Appointment Map and on the map annexed at the point marked AJ on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 15, 16, 17, 18,19,19A, 20, 21, 22, 29, 66, 67, 68, 69, 70, 71, 72, 73, 74, and 76 and the old Inclosures numbered 403, 69, 69a, 68, 68a, 66, 67, 54, 54a, 55, 56, 59, 60, 60a, 61, 62, 63 and 64 respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed.

One other private carriage and occupation road of the width of twenty feet and numbered VII on the said map commencing at the private carriage and occupation road numbered VI at the point marked AK on the said map and extending thence in a Northward direction to and terminating at an old Inclosure numbered 53 on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed at the point marked AL on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 17, 18, 20 and 29 and the old Inclosures numbered 53, 74, 75 and 75a respectively on the said Tithe Appointment Map (part numbered 3) and the map annexed.

One other private carriage and occupation road of the width of fifteen feet and numbered VIII on the said map commencing at the Leighton Way at the point marked AM on the said map and extending thence in a Westward and Southward direction to and terminating at an old Inclosure numbered 84 on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed at the point marked AN on the said map which said road is set out for the use of the persons interested for the time being in the said old Inclosure numbered 84 on the said Tithe Appointment Map (part numbered 3) and on the map annexed.

And I direct and appoint that the said private carriage and occupation road shall for ever hereafter be maintained and repaired by the owner and proprietor of the old Inclosure numbered 84 on the said Tithe Appointment Map and on the map annexed.

Road No.9

One other private carriage and occupation road of the width of twenty two feet and numbered IX on the said map commencing at the Leighton Way at the point marked AO on the said map and extending thence in a Westward direction to and terminating at an old Inclosure numbered 38 on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) at the point marked AP on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 6, 7, 8, 10, 11, 14, 34, 35, 36, 37 and 38, and the old Inclosures numbered 24, 25, 26, 27, 29, 30, 31, 32, 38, 39, 40, 41, 41a, 41b, 45, 47, 48, 49, 49a, 57 and 58 respectively on the said Tithe Appointment map (part numbered 3) and on the map annexed.

One other private carriage and occupation road of the width of twenty feet and numbered X on the said map commencing at the private carriage and occupation Road numbered IX at the point marked AQ on the said map and extending thence in a Northwestward direction to and terminating in the Allotment numbered 6 at the point marked AR on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 6, 7 and 8 and the old Inclosures numbered 33, 34, 35, 36, 37, 37a and 37b respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are severally rated to the relief of the poor.

Road No.11

One other private carriage and occupation road of the width of twenty feet and numbered XI on the said map commencing at the private carriage and occupation road numbered IX at the point marked AQ on the said map and extending thence in a Southeastward direction to and terminating at the Allotment numbered 11 at the point marked As on the said map which said road is set out for the use of the persons interested for the time being in the Allotments numbered 10 and 11 and the old Inclosures numbered 42, 43, 44 and 46 respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed.

And I direct and appoint that the expense of maintaining and repairing the said private carriage and occupation road shall for ever hereafter be raised by rates to be levied on all Allotments made under this Inclosure except the Allotments numbered 33, 34, 104, 122, 123, 188 and 208 respectively in proportion to the value at which they are severally rated to the relief of the poor.

Road No.12

One other private carriage and occupation road of the width of twelve feet and numbered XII on the said map commencing at the Slapton Road at the point marked AT on the said map and extending thence in a Northwestward direction to and terminating at an old Inclosure numbered 9 on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and on the map annexed at the point marked AV on the said map which said road is set out for the use of the persons interested in the said old Inclosure numbered 9 on the said Tithe Appointment Map (part numbered 3) and on the map annexed.

And I direct and appoint that the said private carriage and occupation road shall for ever hereafter be maintained and repaired by the owner and proprietor of the old Inclosure numbered 9 on the said Tithe Appointment map (part numbered 3).

Road No.14A

One other private carriage and occupation road of the width of twenty feet and numbered XIVA on the said map commencing at the Church and Eaton Gate Road at the point marked BP on the said map and extending thence in a Northwest direction to and terminating at the Allotment numbered 97 on the said map at the point marked BO on the said map which said private carriage and occupation road is set out for the use of the persons interested for the time being in the said Allotment 97 and also in the Allotment 115 on the said map and the old Inclosures numbered 166, 166a, 169, 169a and 168 respectively on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3).

And I direct and appoint that the said private carriage and occupation road shall at all times hereafter be maintained and repaired by the owners for the time being of the said Allotments 97 and 115 and the said old Inclosures numbered 166, 166a, 169, 169a and 168 in the proportions in which they are or shall be respectively rated to the relief of the poor.

Road No.14b

And one other private carriage and occupation road of the width of twelve feet and numbered XIVb on the said map commencing at the Edlesborough Green Road at the point marked BQ on the said map and extending thence in an Eastward direction to and terminating at the North corner of an old Inclosure numbered 183 on the Tithe Appointment Map of the said parish of Edlesborough (part numbered 3) and E183 on the map annexed at the point marked BR on the said map which said road is set out for the use of the persons interested in the said old Inclosure numbered 183 on the said Tithe Appointment Map (part numbered 3) and E183 and E183a on the map annexed.

And I direct and appoint that the said private carriage and occupation road shall for ever hereafter be maintained and repaired by the owners for the time being of the said old Inclosure numbered 183 on the said Tithe Appointment map (part numbered 3) and E183 and E183a on the map annexed.

Bridleways

Ivinghoe Bridleway

And I further declare that I have set out and appointed and do hereby set out and appoint One Public Bridleway of the width of twelve feet to be called the Ivinghoe Bridleway commencing at the Leighton Way at the Southeast corner of the church yard at the point marked AG on the said map along the private carriage and occupation Road numbered V and extending thence in a Westward direction to and terminating at the Wash Brook at the point marked AV on the said map.

 

 

Miscellaneous Allotment Awards

Northall Allotments

And I have also set out and do hereby set out allot and award unto the Churchwardens and Overseers of the poor of the said parish of Edlesborough all that piece or parcel of land numbered 33 on the said map containing three acres and eight perches on Northall Green to be held by them and their successors in trust as an Allotment for the labouring poor of the said parish of Edlesborough subject nevertheless to and chargeable with a clear rent charge of four pounds which said sum does not exceed the net annual value of the said Allotment in its present condition. And I declare the same to be of the value of such number of imperial bushels and decimal parts of an imperial bushel of wheat barley and oats as hereinafter set forth, that is to say

Northall Green

And I declare that I have set out and do hereby set out allot and award unto the Right Honourable John William Spencer Brownlow Egerton Cust Earl Brownlow who has consented to receive the same as part of his Allotment to be held by him and his heirs and assigns subject to the obligation of preserving the surface thereof in good condition and of permitting the same to be used as a place for exercise and recreation for the inhabitants of the said parish and neighbourhood, all that Allotment piece or parcel of land numbered 34 on the said map containing four acres and six perches situate on Northall Green, the fences on the Northwest and Northeast sides whereof I direct shall from time to time be repaired and maintained by and at the expense of the owners and proprietors for the time being of the Allotments hereinafter set out numbered 38

And I have also set out and do hereby set out and allot and award unto the said Churchwardens and Overseers of the poor all that piece or parcel of land numbered 104 on the said map containing five acres and twenty two perches situate in Summer Leys to be held by them and their successors in trust as an Allotment for the labouring poor of the said parish of Edlesborough subject nevertheless to and chargeable with a clear rent charge of three pounds and two shillings which said sum does not exceed the net annual value of the said Allotment in its present condition. Dagnall Allotments

And I have also set out and do hereby set out and award unto the said Churchwardens and Overseers of the poor all that piece or parcel of land numbered 208 on the said map containing six acres situate on Pratts Hill hereinafter awarded in exchange. And I direct that the fences on the West and North sides of such Allotment shall from time to time be repaired and maintained by and at the expense of the owner thereof for the time being.

And I do hereby with the consent in writing of the persons interested in the land exchanged hereinafter mentioned set out allot and award such parts of the land to be inclosed as are next hereinafter specified in exchange for the other land in the said parish, and in the adjoining parish of Ivinghoe, hereinafter also particularly described, that is to say;

Unto the said Earl Brownlow all that Allotment numbered 208 on the said map containing six acres in exchange for all that piece or parcel of old inclosed freehold land situate in the said parish of Edlesborough and numbered E139a on the said map and containing four acres one rood and fourteen perches which said piece or parcel of old inclosed land I hereby set out and award unto the Churchwardens and Overseers of the poor of the said parish of Edlesborough in exchange for the said Allotment numbered 208 as aforesaid to be held by them and their successors in trust as an Allotment for the labouring poor of the said parish of Edlesborough subject nevertheless to and chargeable with a clear rent charge of four pounds nine shillings and ten pence, which said sum does not exceed the net annual value of the said Allotment in its present condition.

And I declare the same to be of the value of such number of imperial bushels and decimal parts of an imperial bushel of wheat barley and oats as hereinafter set forth, that is to say

Allotment Rent Charges

And I further set out allot and award the said rent charges amounting together to the sum of fifteen pounds seventeen shillings and two pence payable out of the Allotments for the labouring poor unto and amongst the several persons and in the proportions hereinafter mentioned, that is to say;

Unto Thomas Hankey Esquire, the Right Honourable Sir Edward Ryan Thomson Hankey Esquire M.P. and the Lord Charles James Fox Rufsell, Trustees of a charity known as Ashton’s Charity, the rent charge on the Allotment situate on Edlesborough Green and numbered 123         £3-9s-0d

Unto the said Earl Brownlow the rent charges on the Allotments numbered 33 and E139a respectively                                                                                                                             £9-6s-2d

And unto Felix Ladbroke Esquire, Sir William Curtis, Robert John Harper Esquire, the Right Honourable William Beresford M.P. and Frederick Dawes Danvers Esquire, Trustees of the Mrs Jane Cart’s Charities, the rent charge on the Allotment situate in Summer Leys and numbered 104                                                                                                                                             £3-2s-0d

                                                                                                                                        Total £15-17s-2d

Edlesborough Green

And I further declare I have set out and do hereby set out allot and award to the Trustees of Ashton’s Charity who have consented to receive the same as part of their Allotment to be held by them and their heirs and assigns subject to the obligation of preserving the surface thereof in good condition and of permitting the same to be used as a place for exercise and recreation for the inhabitants of the said parish and neighbourhood, all that Allotment piece or parcel of land numbered 122 on the said map containing four acres situate on Edlesborough Green, the fences on the Northwest, Northeast and Southeast sides whereof I direct shall from time to time be repaired and maintained by and at the expense of the said Trustees of Ashton’s Charity or other owners and proprietors for the time being of the said Allotment.

Vicar’s Awards

Two awards were made to the Vicar of the parish of Edlesborough, Allotments 96 and 97. Allotment 97 was free of any obligations, but Allotment 96 was "subject to the repairs of the Church Lane". The map does not identify which is Church Lane.
